I am required to present you with a copy of this and obtain your signature to verify you fully understand the different types of agencies involved in a real estate transaction. Basically, I want to protect you and your interests. At some point I will ask you to review and sign this document as required by law. This is not obligating you to anything, it is simply informing you of your rights granted by the state of North Carolina and practiced by all licensed realtors in NC.
Having a buyers agent greatly improves your negotiating power by creating a shield of privacy between both parties. What if you walked by the home you’ve been looking for and see a giant for sale sign in the front yard? Let’s say it’s an open house and you’re viewing the property while the listing agent is there. Now imagine you tell the listing agent that the house is everything you’ve been looking for, you’re in a crunch to move quickly, and lots of other personal details about your situation. If they’re doing they’re job as a seller agent, they’ve already told the property owner everything. At this point you’ve given the selling agent all kinds of information that will be given to the property owner that will be used against you in a negotiation. This doesn’t always happen, but if you’re interested in purchasing a home, it’s almost always in your best interest to sign a buyers agreement with a real estate agent who will act as your buyers agent to protect your interests.

Due diligence is a term used often in real estate. Sellers usually don’t have to worry about due diligence, because they’re just getting money for their property. Due diligence relies solely on the shoulders of the buyer in a typical real estate transaction.
I’m sure you may have read someone at some point say: “Make sure you do your due diligence.” Due diligence is your duty as a buyer to investigate the purchase of a property. When you make an offer, you will typically be asked to include a due diligence period. This is the amount of time you have available at your disposal to perform any home inspections required by you or your lender. When you’re shown a house, you usually have a short time to look over aesthetic things such as layout, paint color, location, etc… Most lenders will usually require a home inspection and an appraisal, which involves a more detailed approach to inspecting your investment. Purchasing a home or other piece of real estate is ultimately your decision. You’re going to want to make sure you back up your decision with proper analysis and research.
A home inspection in the state of North Carolina is an inspection performed by a professional licensed by North Carolina Inspector Licensure Board. You can of course do your own inspection for your own purchase, but unless you know what you’re doing this is ill advised. Hiring a professional provides an unbiased look at the property. The inspection report provided by a licensed home inspector is an evaluation of the visible components of a home such as electrical, heating, plumbing, roofing, foundation and others. A home inspection is not an appraisal, nor does it provide you with estimated costs of repairs. To get estimates for repair it is highly recommended to call an appropriate contractor who is licensed and experienced.
The buyer is usually obligated to pay for a home inspection. It is advised that you be present during the home inspection so the inspector can advise you in person of the report. There are many things a home inspection report does not cover, and this is best handled by simply asking the home inspector. Once you have a home inspection, this report belongs to you, because you paid for it. The home inspector has your best interest in mind, since you’re the employer. It is not uncommon for a seller to provide a home inspection if they are motivated to sell a property. In this case a home inspection report and details of repairs made to a property are usually provided to avoid a redundant home inspection. Of course if you don’t feel comfortable with this you can always order your own. If you’re thinking of selling a home it’s a good idea to order a home inspection so you can make repairs yourself before a buyer brings it to your attention before closing.
If you’re borrowing money to purchase a property, the lender will almost always require an appraisal. This is to make sure the amount of money they’re fronting for the purchase is protected by using the home as collateral. There will usually have to be at least a 100% value to loan ration. In other words, you probably can’t borrow a million dollars if the market value worth five hundred thousand. In this scenario, the property would need to appraise at one million or more for the bank to consider it a good investment.
